DESCRIPTION OF SERVICE. Midwest Grain Marketing provides a range of marketing and advertising services including digital campaign management and analytics. Any new features augmenting or enhancing the current Services are subject to these Terms. The Services are provided on an “AS-IS” basis, and Midwest Grain Marketing assumes no responsibility for timeliness, deletion, mis-delivery, or failure to store any communications or personalization settings. Access and use of the Services may involve third-party fees (such as Internet access fees).

YOUR REGISTRATION OBLIGATIONS. In using our Services, you confirm you are legally capable of entering into binding contracts and are not barred under any applicable laws. You agree to: (a) provide accurate, current, and complete information during the registration process and (b) maintain and update this information. If you provide false or incomplete information, or Midwest Grain Marketing suspects as much, we reserve the right to suspend or terminate your account.

PAYMENT AND FEES. A. Payments are processed through approved methods, including credit cards and PayPal. You authorize Midwest Grain Marketing to charge for subscription and overage fees. B. Any changes in third-party charges will be passed on to you at cost.

PRIVACY POLICY. Our Privacy Policy applies to your use of Midwest Grain Marketing’s Services, including data collection and usage. Your use of our Services indicates your consent to this policy.

ACCOUNT, PASSWORD, AND SECURITY. Upon registering, you will receive account and password details. You are responsible for maintaining confidentiality and all activities that occur under your account. Notify Midwest Grain Marketing immediately of any unauthorized use.

MEMBER CONDUCT, REPRESENTATIONS, AND WARRANTIES

A. You are responsible for all content you distribute through our Services and must comply with legal standards. B. The Service must not be used for illegal activities, harassment, spam, or other harmful practices. C. Midwest Grain Marketing reserves the right to pre-screen, refuse, or remove any content.

COMPLIANCE WITH LAWS. You must adhere to all applicable laws and regulations, including those related to messaging and telecommunications.

DOWNTIME & REFUND POLICY. A. “Downtime” refers to periods when Services are unavailable due to technical issues. B. We strive to limit Downtime and will credit your account for excessive Downtime, subject to written request and conditions.

CONTENT POLICY. Midwest Grain Marketing does not claim ownership of your content but requires a license to use it in relation to the Services.

INDEMNITY. You agree to indemnify Midwest Grain Marketing against claims related to your use of the Services.

GENERAL PRACTICES REGARDING USE AND STORAGE. Midwest Grain Marketing establishes general practices for Service use but is not liable for message storage or transmission failures.

MODIFICATIONS TO SERVICE. Midwest Grain Marketing reserves the right to modify or discontinue the Service.

TERMINATION. Midwest Grain Marketing may terminate your account under certain conditions, such as violations of these Terms.

PROPRIETARY RIGHTS. All rights in the Services remain with Midwest Grain Marketing.

DISCLAIMER OF WARRANTIES. The Service is provided without warranties and your use is at your own risk.

LIMITATION OF LIABILITY. Midwest Grain Marketing is not liable for indirect or incidental damages resulting from Service use.

NOTICE. Changes to these Terms will be communicated through appropriate channels.

TRADEMARK INFORMATION. Midwest Grain Marketing’s trademarks cannot be used without prior written consent.

COPYRIGHT CLAIMS. Procedures for addressing copyright infringement claims are outlined.

GENERAL INFORMATION

• Choice of Law: Governed by the laws of The United States of America.

• Waiver and Severability: The failure to enforce any right doesn’t waive it. Invalid provisions don’t affect the rest of the Terms.

• Non-Transferability: Accounts are non-transferable without consent.

• Entire Agreement: These Terms constitute the entire agreement between you and Farmers Trading Company.

Midwest Grain Marketing Alerts

1. These alerts will notify members under the Level 1, Level 2, and Level 3 services we offer of any important news/meetings that may be coming up in the future that will affect them.
2. You can cancel the SMS service at any time. Simply text “STOP” to the shortcode. Upon sending “STOP,” we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.
3. If you experience issues with the messaging program, reply with the keyword HELP for more assistance, or reach out directly to [email protected]
4. Carriers are not liable for delayed or undelivered messages.
5. As always, message and data rates may apply for messages sent to you from us and to us from you. You will receive roughly 4 messages per month. For questions about your text plan or data plan, contact your wireless provider.
